Damp and mould can seriously affect your tenants’ health - and your legal standing as a landlord. Here's what you're responsible for, and how we can help keep your property safe and compliant.

A Safe Home is a Legal Requirement – Not Just a Nice-to-Have

As a landlord, you’re legally required to make sure your rental property is safe, warm and free from damp or mould. But it’s not just about ticking legal boxes — it’s about protecting your tenants’ health and safeguarding your investment.

Common Causes of Damp & Mould

  • Condensation: Moisture collecting on cold surfaces due to poor ventilation or heating

⚖️ What the Law Says

You must ensure your property is:

  • Free from Category 1 Hazards under the Housing Health and Safety Rating System (HHSRS)

  • Fit for human habitation (Landlord & Tenant Act 1985, updated by the Homes Act 2018)

  • Compliant with the Environmental Protection Act 1990 (for health-impacting conditions)

  • At least E-rated on your EPC for energy efficiency

Failure to act can lead to legal action, enforcement by local authorities, or even compensation claims.

Your Responsibilities as a Landlord

  • Provide a valid EPC, Gas Safety Certificate, and EICR

  • Fit working smoke alarms and CO detectors

  • Deal promptly with any reports of damp or mould

  • Educate tenants on proper ventilation – but never use this as an excuse not to fix the source

  • Maintain roofs, gutters, windows, seals and ventilation systems

  • Record inspections and repairs as part of best practice
